A court judgment was obtained against Batsha Ba Tirong Financial Management (Pty) Ltd on December 19, 2022 to pay R10 million to their subcontractors, Morning Glory Security Services.

A LAWYER’S letter has been addressed to the HOD at the Department of Roads and Public Works, Dr Johnny Mackay, to deposit R10 million into the bank account of Batsha ba Tirong Financial Management (Pty) Ltd so that its sub-contractor, Morning Glory Security Services, can receive outstanding payments.

A court judgment was obtained against Batsha Ba Tirong Financial Management (Pty) Ltd on December 19, 2022 to pay R10 million to their subcontractors, Morning Glory Security Services.

According to the lawyer’s letter, the owner of Batsha ba Tirong Financial negotiated with the Department of Roads and Public Works to change the bank account details to circumvent the court order.

The Department of Roads and Public Works had previously agreed to pay outstanding payments to Morning Glory Security, on behalf of Batsha Ba Tirong Financial Management (Pty) Ltd.

Due to non-compliance with this judgment, a consequent court order was awarded by the Northern Cape High Court on January 13 that the Standard Bank account of Batsha ba Tirong Financial Management be frozen, until the outstanding R10 million is paid over to Morning Glory Security.

This is the same bank account in which the Department of Roads and Public Works makes payments to Batsha ba Tirong Financial Management for security services rendered at the department’s premises.

“It is our instruction that should your department assist in changing the bank details or fail to deposit any money to Batsha ba Tirong Financial Management, into the Standard Bank account, the HOD will be held liable and our client (Morning Glory Security) will obtain the necessary legal relief,” the letter added.

Spokesperson for the department, Crystal Robertson, indicated that none of the bank account details were altered.

“We will await the outcome of the court process. We should not lose sight that this is a matter between the main contractor – Batsha ba Tirong Financial Management (Pty) Ltd) and the sub-contractor – Morning Glory Security.”
