Thuli Madonsela criticises Phala Phala report, says law experts erred

Former public protector Thuli Madonsela has criticised the expert report into the robbery at President Cyril Ramaphosa’s farm. She said she found that the panel of esteemed law experts had erred in their findings and interpretation of the law.

JOHANNESBURG – Former public protector (PP) Thuli Madonsela has criticised the expert report into the robbery on President Cyril Ramaphosa’s farm, where millions of stashed dollars were stolen.

In an interview with a local news channel, Madonsela said she found that the panel of esteemed law experts had erred in their findings and interpretation of the law.

The former PP, now a law lecturer at Stellenbosch University (SU), said the report should be taken on review because of errors in the interpretation of the law.

“I am concerned about the interpretation of the law because I teach investigations and constitutional law. Section 34 (1), the heading is reporting corrupt activities. I think in this case, Justice Ngcobo failed us on this one. He applied a law that does not apply in this particular case,” Madonsela said.

Madonsela, together with University of Cape Town (UCT) Professor Richard Calland, have both expressed reservations about the report and raised concerns about the lack of tangible evidence used to compile the report.

“With due respect, I have the greatest respect for all three panellists, but human beings do err, which is why we get dissenting judgments, and we get reviews. This is a duty to report corrupt activities. The president has been accused of failing to report the loss of his own money on his own private property,” Madonsela said.

Madonsela broke her silence on the matter following criticism from different politicians, but some have seen her as leaning towards the Ramaphosa faction in the ANC because of her proximity to white monopoly capital.
