THE APPLICATION brought before the Electoral Court in Bloemfontein by the Forum for Service Delivery to disqualify the ANC candidate who contested the by-election in Magareng municipality last week, has been dismissed.

The urgent application prevented the Independent Electoral Commission (IEC) from formally announcing the outcome of the by-election, where the ANC had secured the most votes.

IEC provincial electoral officer, Bonolo Modise, said that the court was unable to find adequate reason to disqualify the ANC candidate.

Meanwhile the Ubuntu Municipality has confirmed that the independent councillor, Krisjan James Arens, had not joined the ANC. The ousted mayor of the Ubuntu Municipality, Paula Jantjies, claimed in lawyers letters that Arens was an ANC member.

Ubuntu municipal manager, Thandazani Makhoba, stated in correspondence that he was not aware of any valid reason to declare a vacancy in ward 4.
