Derrick Fyvers and Marlin Koopman, who are accused of the murder of 29-year-old Ashwin Malan have pleaded not guilty to all the charges against them.
THE TWO men, Derrick Fyvers and Marlin Koopman, who are accused of the murder of 29-year-old Ashwin Malan who was fatally shot at his mother’s guest house, Atlantis Guesthouse in Kimberley, have pleaded not guilty to all the charges against them.
The trial of the pair commenced in Northern Cape High Court.
Malan died on the night of September 8, 2016 after he was shot three times during what was at the time believed to have been a botched robbery.
Fyvers, who is believed to be the shooter in the incident, was arrested in Gauteng after he was sought by police.
Fyvers, through his legal representative, Advocate Themba Diba, told the court that he was not in Kimberley during the time of the offence.
“My client will bring a defence of an alibi. The accused has indicated that on the day and time the alleged offence took place, the accused was not in Kimberley. He (Fyvers) left Kimberley at 4pm on the same day the offence took place. He arrived in Pretoria at around 9pm that evening. He could not have been at the place and at the time the incident took place. The accused Indicated that he would call a witness to support his defence if needs be. A friend of the accused took him to the taxi rank in Kimberley and saw him leave in the taxi to Gauteng. He will call other witnesses to state that he indeed arrived in Gauteng,” said Diba.
The case continues and both accused remain in custody.
